Terms and Conditions
(DPDP Act, 2023 – Section 8 Compliant)

These Terms and Conditions (“Terms”) govern the access to and use of the website, applications, platforms, software, and services (collectively, the “Platform”) operated by Alinexora Tech Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Korian Wali, Fazilka-152123, Punjab, India (“Company”, “We”, “Us”, or “Data Fiduciary”).
By accessing or using the Platform, you (“User”, “You”, or “Data Principal”) agree to be bound by these Terms, the Privacy Policy, and all applicable laws, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”).
1. Legal Basis and Applicability
These Terms are framed in accordance with:
- the Digital Personal Data Protection Act, 2023;
- applicable Information Technology laws of India; and
- contractual principles governing electronic records.
These Terms constitute a legally binding agreement and an electronic record under Indian law and do not require physical or digital signatures.
2. Role under DPDP Act
- Alinexora Tech Private Limited acts as a Data Fiduciary.
- Users whose personal data is processed are Data Principals.
- Any third party processing data on behalf of the Company acts as a Data Processor.
3. Consent and Lawful Purpose
3.1 The Company shall process personal data only:
- for lawful purposes;
- with clear, specific, informed, and unambiguous consent, or
- for legitimate uses as permitted under the DPDP Act.
3.2 By using the Platform, the Data Principal expressly consents to the processing of personal data for:
- providing services;
- account management;
- communication and support;
- compliance with legal obligations; and
- system security, analytics, and service improvement.
3.3 Consent may be withdrawn at any time in accordance with Section 6 of the DPDP Act, subject to legal and contractual obligations.
4. Obligations of the Company (Section 8 Compliance)
4.1 Accuracy of Personal Data
- accurate,
- complete, and
- updated,
having regard to the purpose for which such data is processed.
4.2 Reasonable Security Safeguards
- access controls,
- encryption where appropriate,
- role-based access,
- secure hosting environments, and
- monitoring mechanisms
4.3 Data Breach Notification
- notify the Data Protection Board of India, and
- inform affected Data Principals,
4.4 Data Retention and Erasure
- retained only as long as necessary for the stated purpose or legal compliance; and
- erased upon withdrawal of consent or completion of purpose, unless retention is required by law.
4.5 Grievance Redressal
5. Obligations of the Data Principal
- provide accurate and lawful personal data;
- not impersonate another individual;
- not suppress or misrepresent material information; and
- comply with all applicable laws and these Terms.
6. Rights of Data Principal
- access information about personal data processed;
- request correction or erasure of personal data;
- withdraw consent;
- nominate an individual to exercise rights in the event of death or incapacity; and
- lodge a grievance with the Company or the Data Protection Board of India.
7. Data Processors and Third Parties
The Company may engage Data Processors only under valid contractual arrangements and obligations consistent with the DPDP Act. The Company shall not sell personal data and shall disclose data to third parties only with consent, for lawful purposes, or where required by law.
8. Children’s Data
The Platform does not knowingly process personal data of children without verifiable parental or guardian consent and compliance with restrictions under the DPDP Act.
9. Intellectual Property
All intellectual property rights in the Platform, including software, content, trademarks, and designs, remain the exclusive property of the Company.
10. Limitation of Liability
- the Company shall not be liable for indirect, incidental, or consequential damages;
- liability for data-related issues shall be limited to statutory remedies under the DPDP Act.
11. Termination
The Company may suspend or terminate access to the Platform if these Terms are violated, unlawful activity is detected, or required by law or regulatory authority.
12. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Courts having jurisdiction at Uttar Pradesh, India, shall have exclusive jurisdiction.
13. Amendments
The Company may amend these Terms to comply with changes in law or business practices. Continued use of the Platform after notification constitutes acceptance.
